Privacy statement for the benefit of applicants

As a data controller, Westacc B.V. processes your personal data because you apply to our organisation, respond to a vacancy or otherwise express an interest in performing work for Westacc. Westacc processes that personal data in accordance with applicable privacy legislation, including the General Data Protection Regulation (AVG). In this statement, Westacc provides you with information on how it processes your personal data in connection with the aforementioned activities and what rights you have in that respect.

Purposes of processing

Your personal data may be provided by you to Westacc or to a person affiliated with Westacc, through the contact form on the website, by post or by email. This may include, for example, name and address details, education details or contact details.

Westacc may process this and other personal data provided for the following purposes:
- establishing and maintaining contact;
- answering questions asked by you or providing information requested by you;
- making a selection of candidates to start a job application procedure with;
- going through a job application procedure;
- keeping proper records and internal management;
- handling any complaints you may have and resolving disputes;
- going through the pre-contractual stage with you and being able to enter into an (employment) agreement with you;
- allowing you access to Westacc's sites, buildings and premises;
- informing you of developments within Westacc;
- marketing purposes;
- to guarantee the safety of you, other persons and goods;

Westacc processes the personal data obtained only for the above purposes. If Westacc intends to process your personal data for other purposes, Westacc will contact you to give you the opportunity to object to further processing. This will be done prior to any further processing, with information about that other purpose and any relevant further information shared with you.

Legal basis(s) for processing

The processing operations for the above purposes each have at least one legal basis. These legal bases are explained below.

Consent
The legal basis consent applies when you have given free, explicit, unambiguous consent to Westacc to process your personal data. If Westacc processes personal data on the basis of consent granted by you, you always have the right to withdraw this consent. If processing takes place solely on the basis of the consent granted by you, then once you have withdrawn your consent, no further processing may take place. The withdrawal of consent does not affect the lawfulness of processing based on the consent before its withdrawal.

Pre-contractual measures
In a number of cases, we base processing on your request for pre-contractual measures for the purpose of being able to conclude an agreement. For example, if you want Westacc to enter into an employment agreement with you, it is necessary to process one or more of the aforementioned personal data in that context.

Consideration of interests
The processing of your personal data is in some cases necessary for the protection of the legitimate interests of Westacc or a third party. In that case, Westacc assesses whether your interests and fundamental rights or freedoms outweigh those legitimate interests. Only if this is not the case will Westacc process your personal data on the basis of the balancing of interests.

If Westacc processes personal data (partly) on the basis of a balancing of interests, Westacc mentions the legitimate interests and informs you accordingly.

Consequences of not providing personal data

Westacc will inform you in advance of cases where you are required to provide personal data which must then be processed by Westacc pursuant to:
- A legal or contractual obligation and/or;
- because this is a necessary condition for entering into an agreement.

In that case, you will also be informed of the consequences of your possible refusal to provide this personal data.

Westacc makes clear in the vacancy text which (personal) data are minimally required to assess whether you will be admitted to the application procedure. If you do not (fully) provide this personal data, Westacc may decide not to admit you to the procedure. Additional (personal) data may be requested at any stage of the application procedure. The consequences of not providing these data will be explained. If Westacc eventually decides to enter into an employment agreement with you, Westacc may also require you to provide additional (personal) data in order to enter into the agreement. The consequences of not providing these data will also be explained.

Retention periods

If you make general information requests and/or ask questions, Westacc will retain your personal data provided to it for as long as there is continuous contact on the same subject. After no further contact has taken place for four weeks, your personal data will be deleted within the following month.

If you apply or express a concrete interest in a vacancy or performing work for Westacc, Westacc will retain your personal data provided to it for as long as the application procedure is ongoing and/or mutual interest is expressed in possibly entering into an employment agreement. Your personal data will be deleted within four weeks after completion of the application procedure or - when no further contact has taken place for four weeks - at the latest within four weeks thereafter. The foregoing suffers an exception if you consent to your personal data being stored for longer. In that case, your personal data will be stored for a maximum of one year after consent.

In the event of complaints or disputes regarding the contact or application procedure, your personal data will be kept for the duration of the handling of these complaints and disputes. When it is clear that a complaint or dispute has been resolved, the personal data retained for this purpose will be deleted.

Additional information on dispensing and processing

Your personal data may be provided to other recipients. For example, organisations that support Westacc in recruitment and selection, to check references or to conduct an assessment (or have one conducted). There is no transfer of personal data to third countries or international organisations.

Finally, no automated decision-making and profiling takes place.

Your rights

Under the AVG, you are entitled to various rights in relation to your personal data:
- the right to inspect and copy;
- the right to rectification;
- the right to data erasure;
- the right to restrict processing;
- the right to object to processing;
- the right to data portability;
- the right not to be subject to automated decision-making.

If you wish to exercise your rights, you may submit a request using the contact details provided in this statement. Please note that the above rights are not absolute. That is, Westacc does not have to comply with a request to exercise any of the aforementioned rights in all cases.

Within one month after Westacc has received a request from you to exercise one of the aforementioned rights, Westacc will inform you. In doing so, Westacc will indicate whether and how it will comply with your request and, if not, why not. If necessary in connection with the request, Westacc may extend the response period of one month. In that case, Westacc will inform you within one month of the response period. Exercising the right(s) by you is in principle free of charge.

Filing a complaint with the regulator

It is possible that, despite Westacc's careful approach, you may have a complaint about the way Westacc processes your personal data and/or handles your rights. You can then file a complaint with the regulator. In the Netherlands, the Personal Data Authority is the supervisor in the field of processing personal data. You can find the contact details of the Personal Data Authority via the website www.autoriteitpersoonsgegevens.nl.
